This Privacy Policy provides transparent information to the user about how and to what extent we - as well as third parties mentioned in this Privacy Policy - collect, process, store, and protect personal data, taking into account the principles of the Swiss Federal Data Protection Act (hereinafter "DSG").

As part of our business relationship, you must provide the personal data necessary for the establishment and implementation of a business relationship and the fulfillment of associated contractual obligations. Without this data, we will generally not be able to enter into or process a contract with you. The website cannot be used either if certain information to ensure data traffic (such as IP address) is not disclosed.

1. RESPONSIBILITY

The data controller within the meaning of the DSG for providing the website is:

Torcello operates the website torcello.ch (hereinafter "Website").

If you place an order with a Torcello franchisee or apply with such a franchisee, the respective Torcello franchisee mentioned in the order is responsible for the respective data processing.

2. PURPOSES OF DATA PROCESSING

2.1 PROVISION OF OUR SERVICES

Personal data includes all information that relates to a specific or identifiable natural person. This includes, for example, name, address, telephone number, and email address.

Personal data of our customers are only processed to the extent necessary for providing a functioning website as well as our content and services (especially the online ordering service and marketing activities).

The data provided by the user during ordering and/or registration is transmitted to us and stored by us for the purposes stated in this Privacy Policy. Similarly, it is transmitted to the respective Torcello franchisee responsible for the individual order and/or application. No personal data of users is processed if our website is visited purely for informational purposes, subject to Section 6 and subsequent.

2.2 CREATION OF LOG FILES

With each call and use of our website, general data and information, in particular server log files, are automatically collected and stored by our system (e.g., IP address of the user, date and time of access to our website, etc.). These data are not merged with other data sources.

We use this user browsing behavior data to create aggregated statistics (so that statistics do not allow conclusions about individual users, but only display the collected data of multiple users), for example, to find out what interests our users and thus improve our websites and offerings.

2.3 NEWSLETTER

On our website, we offer users the option to subscribe to a newsletter. For data processing, user consent is obtained during the registration process, and reference is made to this Privacy Policy. The user can revoke this consent at any time. A corresponding notice is included with each newsletter sent by email. The data entered by the user in the newsletter subscription form is used exclusively for sending the requested information and newsletter and is not passed on to third parties.

2.4 CONTACT FORM AND EMAIL CONTACT

The user has the option to send electronic inquiries to us via the contact form provided on our website or by email. The data provided in this contact form are stored by us for processing the request and any follow-up questions and are not disclosed to third parties - except to Torcello franchisees who may be affected by the inquiry. We also use this data to create anonymized statistics to improve our website and offerings.

2.5 APPLICATIONS

If you apply for a job offer, Torcello - and/or the respective Torcello franchisee - collects, stores, and processes the data you submit to us for reviewing your application and the entire application process.

If no employment relationship is established, we - and/or the respective Torcello franchisee - will only keep your submitted data for as long as necessary and to safeguard our legitimate interests and in accordance with applicable data protection regulations. You can object to this retention at any time.

3. DISCLOSURE OF USER DATA TO THIRD PARTIES

User data is disclosed to third parties when we engage third parties as processors to fulfill our services, for administrative and technical services (e.g., payment processing), and for marketing activities where we aim to improve the marketing experience of our customers.

These third parties may include, in particular: service providers (such as IT providers) of ours, Torcello group companies, Torcello franchisees, acquirers or interested parties in the acquisition of business areas, companies, or other parts of the Torcello group, etc.

These third parties process the data exclusively on our behalf and are contractually obligated to process personal user data only for the purposes within the scope of this Privacy Policy and in compliance with data protection regulations (including necessary security measures). Data processing by third parties for their own purposes does not take place.

In addition, when placing online orders, your personal data will be transferred to the respective Torcello franchisee for processing your order. The Torcello franchisee may also process your personal data for the same purposes as described herein.

4. DISCLOSURE OF USER DATA TO THIRD COUNTRIES

As part of our obligations and provision of services, data may also be transferred abroad, namely the EU.

If a recipient is in a country without adequate legal data protection, we contractually obligate the recipient to comply with applicable data protection regulations, unless it is already subject to a legally recognized framework for ensuring data protection and we cannot rely on an exception provision.

An exception may apply, in particular, in legal proceedings abroad, but also in cases of overriding public interests or if contractual processing requires such disclosure, if you have consented, or if it concerns data made generally accessible by you, to which you have not objected. However, you are aware that data protection may not be guaranteed even if the third country has legislation allowing authorities access to personal data at any time (especially the USA).

5. TECHNICAL AND ORGANIZATIONAL MEASURES

Data processing by us takes place using suitable technical and organizational measures to secure personal data against partial or complete loss, unauthorized access by third parties, and manipulation.

However, the user is aware that electronic data transmission involves risks.

6. COOKIES AND PIXEL TAGS

When visiting our website, we use so-called cookies and pixel tags (web beacons). Cookies are small text files that are stored in the user's browser on their computer. They do not contain information that can directly identify individual users. These cookies are used to track, analyze, and store user browsing behavior on our website and to save settings. We use cookies to optimize and make our website more user-friendly. Most of the cookies we use are called "session cookies". They are automatically deleted after the end of the visit to our website. Other cookies remain stored on the user's computer until they are deleted. These cookies enable us to recognize the user's browser on their next visit. The user can disable the use of cookies in their browser settings, restrict or deactivate cookies, or delete them automatically or manually.

Pixel tags are small graphics that allow us to record log file data and analyze log files for statistical evaluations and marketing purposes.
We would like to point out that completely or partially disabling cookies and blocking pixel tags may result in the user not being able to use our website or not being able to use it to its full extent.

7. WEB ANALYSIS

We also use third-party web analytics services such as Google Analytics on our website. These services use cookies to collect anonymous information such as the number of visitors to the website and the most popular pages. This information is used to improve the website and optimize the user experience. The information generated by the cookie about the use of this website (including the user's IP address) is transmitted to servers of Google or other providers and stored there. These providers will use this information to evaluate the use of the website, compile reports on website activity for us, and provide other services related to website use and internet use. The IP address is not associated with other data from Google or other providers by these services.

The user can prevent the installation of cookies by adjusting their browser software settings; however, we would like to point out that in this case, the user may not be able to use all functions of this website to their full extent.

8. GOOGLE MAPS

Our website uses Google Maps to display maps and create directions. Google Maps is operated by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. By using this website, the user agrees to the collection, processing, and use of data automatically collected and entered by Google, its representatives, or third-party providers.

Google Maps terms of use can be found here.

Google Maps Privacy Policy can be found here.

9. SOCIAL MEDIA PRIVACY POLICY

We would like to point out that we present ourselves on social networks and may process user data outside the European Union. This may be the case, especially if users are members of these platforms and interact with us.

User data is generally processed for market research and advertising purposes. For example, usage behavior and resulting user interests can be used to create user profiles. User profiles can in turn be used to display advertisements within and outside the platforms that presumably correspond to the interests of users. For these purposes, cookies are usually stored on the user's computers, in which user behavior and interests are stored. Furthermore, data can also be stored in the user profiles regardless of the devices used by the users (especially if users are members of the respective platforms and are logged in there).

Further information on the respective processing activities and the options for objection (opt-out) can be found in the privacy policy and information of the respective platform operators.

For data processing outside the European Economic Area (EEA), it should be noted that there may not be an adequate level of data protection. The operators of social networks are certified participants in the Privacy Shield Agreement and thereby undertake to comply with European data protection standards.

10. RIGHTS OF THE DATA SUBJECT

You have the right to obtain information about your personal data stored by us at any time. You also have the right to correction, blocking, or, apart from the prescribed data storage for business processing, deletion of your personal data. Please contact our data protection officer for this purpose. The contact details can be found below.

If you have given us consent to process your data, you can revoke this consent at any time. Such a revocation affects the admissibility of processing your personal data after you have given it to us.

You also have the right to lodge a complaint with a supervisory authority if you believe that the processing of your personal data violates the GDPR.
